2.1. Acceptance
This Legal Notice governs access to the website www.naparbier.com of NAPARBIER S.L. (hereinafter, the “Website”) and the use of the content and services made available to users who access the Website (hereinafter, the “Users”).
Use of the Website by Users implies full and unreserved acceptance of all the conditions included in the Legal Notice in force at each time the Website is accessed. As NAPARBIER S.L. reserves the right to modify this Legal Notice at any time and without prior notice, Users must read it carefully each time they intend to use any of the content or services offered on the Website, as it may have been modified.
Some services on the Website may be subject to specific conditions that replace, supplement, or modify this Legal Notice, and which must likewise be accepted by Users before the provision of the relevant service begins.
NAPARBIER S.L. may freely suspend, block, interrupt, or cancel the Service in the following cases:
1.- to ensure the security of the service or access channel,
2.- when the Website is used fraudulently or abusively,
3.- when maintenance or repair operations of the service are necessary, and
4.- when there is a breach by the User.
Access to the Website is free of charge, except for the cost of connection through the telecommunications network supplied by the access provider contracted by the Users. Access to the Website, and especially the contracting of products and services offered through it, is reserved for persons over 18 years of age. NAPARBIER S.L. shall not be responsible for the consequences arising from non-compliance with this requirement.
2.2. Use
Users undertake to use the services and content of the Website in accordance with the Law and this Legal Notice, and shall be liable to NAPARBIER S.L. or to third parties for any damages or losses that may be caused as a result of failure to comply with these obligations, or as a result of unlawful, negligent, fraudulent actions, or actions that contravene the principle of good faith, generally accepted practices, or public order.
The use of the Website for unlawful purposes, or for purposes harmful to the assets, interests, or reputation of NAPARBIER S.L. or third parties, or that in any way damage, overload, or render unusable the networks, servers, and other computer equipment (hardware) or software products and applications of NAPARBIER S.L. or third parties, is expressly prohibited.
2.3. Content and Intellectual and Industrial Property
All content of the Website, including but not limited to texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or audio content, graphic design and source codes, as well as trademarks, trade names, or distinctive signs, are the property of NAPARBIER S.L. or third parties. NAPARBIER S.L. does not assign or grant Users any license or authorization over the corresponding intellectual and industrial property rights.
NAPARBIER S.L. exclusively holds the rights to exploit the aforementioned intellectual and industrial property in any form, and in particular the rights of reproduction, distribution, public communication, and transformation.
By way of example and not limitation, and in accordance with applicable legislation, Users are prohibited from carrying out the following actions:
1.- Reproducing, copying, distributing, making available, publicly communicating, transforming, or modifying the content, except in cases authorized by law or expressly consented to by NAPARBIER S.L.
2.- Extracting and/or reusing all or a substantial part of the content comprising the Website that NAPARBIER S.L. makes available to Users.
3.- Duplicating, copying, selling, reselling, or exploiting NAPARBIER S.L. services for commercial purposes without prior consent.
4.- Using any trademark, logo, or other copyright-protected information of NAPARBIER S.L. without the corresponding prior authorization.
2.4. Liability
(I) Information and Content
NAPARBIER S.L. strives to ensure that the content on its Website is of the highest possible quality, but does not guarantee its accuracy, completeness, or timeliness. Access to the Website and any use made of the information and content appearing therein is the sole responsibility of Users. NAPARBIER S.L. shall not be liable for any consequences, damages, or losses arising from such access or use.
(II) Quality and Availability of Access
NAPARBIER S.L. does not guarantee the absence of viruses, worms, or any other harmful computer elements. Users are responsible for using appropriate tools, means, or systems for detecting and disinfecting harmful computer elements. NAPARBIER S.L. shall not be liable for damage caused to Users’ or third parties’ computer equipment during or as a result of access to the Website.
Access to the Website requires services and supplies provided by third parties, and it is not the responsibility of NAPARBIER S.L. to control their quality, availability, continuity, or operation. NAPARBIER S.L. shall not be liable for damages or losses of any kind suffered by Users as a result of failures, interruptions, or suspensions of the telecommunications network connection service during access to the Website.
NAPARBIER S.L. does not guarantee the availability, maintenance, or effective functioning of the Website and/or its services. Nevertheless, it will make its best efforts to ensure that the Website is accessible and fully operational at all times.
(III) Links
The Website may include link devices that allow Users to access other Internet pages and portals (hereinafter, the “Linked Sites”). In such cases, NAPARBIER S.L. acts as an intermediary service provider in accordance with Article 17 of Law 32/2002 of July 12, on Information Society Services and Electronic Commerce, and shall only be liable for the content supplied on the Linked Sites insofar as it has actual and evident knowledge of their unlawfulness and has not deactivated the link with due diligence.
If a User considers that there is a Linked Site with unlawful or inappropriate content, they may notify NAPARBIER S.L. so that it may investigate the legality of such content. However, such notification does not oblige NAPARBIER S.L. to remove the corresponding link.
Likewise, Users are informed that the existence of links on the Website does not imply the existence of agreements with the owners or operators of the Linked Sites, nor does it imply recommendation, promotion, or identification of NAPARBIER S.L. with the statements, content, or services offered by the Linked Sites.
NAPARBIER S.L. is not aware of the content and services of the Linked Sites and therefore shall not be liable for damages caused by the unlawfulness, quality, lack of updating, unavailability, error, or uselessness of the content or services of the Linked Sites.
3. Force Majeure
Without prejudice to the foregoing, NAPARBIER S.L. shall not be liable for delays or failures in access to, functioning, and operability of the Website, its Content and/or Services, nor for interruptions, suspensions, or malfunctioning thereof, when these are caused by breakdowns resulting from natural disasters such as earthquakes, floods, lightning, or fires, situations of force majeure, situations of extreme emergency such as wars, military operations, civil disturbances, strikes, lockouts, or any other force majeure or fortuitous event.
4. Indemnification
Users expressly undertake to indemnify NAPARBIER S.L., the companies of its group, employees, directors, agents, and other affected parties for damages and losses (including attorneys’ fees, court agent fees, and legal costs) arising from Users’ breach of these general conditions and any applicable specific conditions, as well as to cooperate with NAPARBIER S.L. in the defense of its interests in the event that any claim is filed or any judicial or administrative proceeding is initiated as a result of such breach. Likewise, Users undertake to make their best efforts to avoid or, where appropriate, mitigate any harmful or adverse effects that may arise for NAPARBIER S.L.
NAPARBIER S.L. shall not be liable for:
– indirect or consequential damages;
– business losses (including loss of profit, revenue, contracts, anticipated savings, data, goodwill, or unnecessary expenses incurred) that are the direct or indirect result of Users’ access to the Website.
5. Security Warning
“Phishing” and other fraudulent acts involving identity theft or impersonation consist of third parties simulating the identity of an entity through the fraudulent use of email in order to deceitfully obtain personal data.
In relations that Users maintain or intend to maintain with NAPARBIER S.L., the following recommendations should be taken into account:
– Under no circumstances will NAPARBIER S.L. request Users’ Website access credentials, either by phone or by email. These data are strictly confidential and must only be used for their intended purpose(s). Any disclosure of confidential data by Users to third parties is their sole responsibility.
– NAPARBIER S.L. will not request by phone or email a copy of the national identity document (ID card, foreigner ID, passport), nor any data relating to bank accounts or positions.
– Users should therefore be wary if they do not previously and directly know the person requesting such data in the name of or on behalf of NAPARBIER S.L. Users should not access the Website/App via a link, email, or web page that is not completely trustworthy. Instead, it is recommended to type the address directly into the browser.
6. Security
Users are responsible for the custody, diligent use, and maintenance of the confidentiality of passwords, access keys, or encryption systems of the equipment acquired and/or installed.
Users agree to assume responsibility for all activities carried out from their account and/or using their password.
7. Partial Invalidity
If any clause of this Legal Notice is declared invalid, null, or ineffective for any reason, such condition shall be deemed excluded, without affecting the validity or enforceability of the remaining conditions.
8. Waiver
If NAPARBIER S.L., in the event of a breach by Users of these Conditions, does not immediately exercise the actions and/or rights available to it, this shall not imply a waiver of the right to exercise them at any other time in the future.
9. Governing Law and Jurisdiction
This Legal Notice shall be governed by Spanish law. NAPARBIER S.L. and the Users expressly waive any jurisdiction that may correspond to them and formally submit to the Courts and Tribunals of Navarra for any dispute that may arise regarding the interpretation or compliance with the Legal Notice governing this Website.
